Mobizim Terms of Use

Our Commitment to You

Welcome to Mobizim, a service built to make it easy for you to manage mobile phones that you own or owned by your family. We understand that the information that you store on your mobile phone is important and personal and you may not want to share it with others. This is why we give you control of your information and you decide what information is important and what you would like to share with others. We will under no circumstances and to be best of our ability, not share any personally identifiable information with 3rd parties, our partners, or affiliates.

The Mobizim service is operated by Mobizim, Inc. (’Mobizim’), and consists of the ZimPlace Web sites and other features and services offered by Mobizim.

Mobizim and its employees take your privacy very seriously. Mobizim’s Privacy Policy is designed to help you understand how we collect information you share with us. To make it easier for you to read and understand our privacy policy, we’ve written it in plain language and tried to keep it to a reasonably short length.

Introduction

Welcome to Mobizim, a service built to make it easy for you to manage mobile phones. ("Mobizim", "The Company", "We", "Our" ) our mobile device software application (the "ZimAgent Software"), Web Site (the "ZimPlace"), web widgets, feeds, and applications for third-party Websites and services, and any other mobile or web service or application owned, controlled, or offered by Mobizim (collectively, the "ZimPlace Service"). By accessing or using our web site at www.mobizim.com or the mobile version thereof (together the "Site"), you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are a registered member of Mobizim. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Service or the Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Service or the Site. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

BEFORE USING ANY MOBIZIM SERVICES, PLEASE READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS OF SERVICE AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

IF YOU DO NOT AGREE TO THIS AGREEMENT, THEN PLEASE CEASE USING THE LIFEAWARE SERVICES IMMEDIATELY.

THE AGREEMENT CONSTITUTES A BINDING CONTRACT BETWEEN YOU AND MOBIZIM.

Eligibility

Membership in the service is voice where prohibited. The Service is intended solely for users who are thirteen (13) years of age or older. Any registration by, use of or access to this Service by anyone under 13 is unauthorized, unlicensed and in violation of these Terms of Use. By using ther Service, you represent and warrant that you are 13 or older and that you agree to and to abide by all of the terms and conditions of this Agreement.

Children Under Age 13

Mobizim does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such person to register. If you are under 13, please do not attempt to register for Mobizim or send any information about yourself to us, including your name, address, telephone number, or e-mail address. No one under age 13 may provide any personal information to or on Mobizim. In the event that we learn that we have collected personal information from a child under age 13 with verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at privacy@Mobizim.com

Children Between the Ages of 13 and 18

We recommend that minors between the age of 13 and 18 should not send any information about themselves to anyone over the internet including sending text messages (SMS) and multimedia message services (MMS).

User Content Posted on the Site

You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, music, video, advertisements, listings, and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the Company violates this Agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others.

When you post User Content to the Site, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting, backup, archive, and storage of the User Content on the Site. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. Mobizim does not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.

COPYRIGHTS AND TRADEMARKS

Mobizim respects the intellectual property of others, and we ask our users to do the same. We prohibit users from uploading data to the Service that violates another party's intellectual property rights. Mobizim may, in appropriate circumstances and in its sole judgment, terminate the accounts of users who violate the intellectual property rights of others.

MOBIZIM, ZIMPLACE, ZIMAGENT, ZIMENGINE, and other Company graphics, logos, designs, page headers, button icons, scripts and service names are trademarks, trademarks or trade dress of Company in the U.S. and/or other countries. Company's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of the Company.

Changes to MObizim and the Terms of Service

We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice. If we do this, we will post the changes to these Terms of Service on this page and we may send registered users an email notifying you of the change. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOU SHALL STOP USING THE BEBO SERVICE. YOUR CONTINUED USE OF THE MOBIZIM SERVICE FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE OR RECEIVING OUR EMAIL NOTIFYING YOU OF THE CHANGE WILL CONSTITUTE YOUR BINDING ACCEPTANCE OF THE CHANGE.
